The Motorsport Safety Foundation ("MSF," "we," "us," or "our") is a 501(c)(3) nonprofit organization dedicated to improving safety in non-competitive motorsports. This Privacy Policy explains what personal information we collect, how we use it, how we protect it, and what choices you have about your information when you visit our website at motorsport-safety.org, register for our courses, subscribe to our communications, or otherwise interact with us.
We take your privacy seriously. This policy is written in plain language because we believe you should be able to understand exactly what we do with your information without needing a lawyer.
By using our website or providing your information to MSF, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this policy, please do not use our website or provide us with your personal information.
1. Information We Collect
We collect personal information that you provide to us directly, as well as limited information collected automatically when you visit our website.
Information you provide to us
When you register for an MSF course, subscribe to our newsletter, contact us, or otherwise interact with MSF, we may collect the following personal information:
• Your name
• Your email address
• Your phone number
• Your mailing address
• Your organization, club, or motorsport affiliation
• Any other information you voluntarily provide in communications with us
Course registration is handled through our registration platform, MotorsportReg.com, operated by PMH MSR LLC. When you register for an MSF course through MotorsportReg, you provide information directly to MotorsportReg, which then shares registration information with MSF as the course provider. MotorsportReg handles its own data collection and storage according to its own privacy policy, which you should review separately at motorsportreg.com.
Payment information for course fees is processed by MotorsportReg and its payment processors. MSF does not directly collect, store, or have access to your credit card or bank account information.
Information collected automatically
When you visit motorsport-safety.org, we automatically collect limited technical information about your visit using Google Analytics 4 (GA4), a web analytics service provided by Google. This information may include:
• Your IP address (in a partially anonymized form)
• The type of device and browser you use to access our website
• The pages you visit on our website and the time you spend on each page
• The website or source that referred you to our website
• Your approximate geographic location based on your IP address (at the city or regional level, not precise location)
We use this information solely to understand how visitors use our website and to improve the visitor experience. We do not use this information to identify individual visitors. Google Analytics may place cookies on your device to collect this information; you can disable cookies in your browser settings or opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on available at tools.google.com/dlpage/gaoptout.
2. How We Use Your Information
We use the personal information we collect for the following purposes:
• To register you for MSF courses and deliver the educational content you have requested
• To communicate with you about your course registration, including confirmations, reminders, and course updates
• To send you MSF newsletters and communications about our programs, events, and safety resources, if you have opted in to receive such communications
• To respond to your inquiries and provide customer support
• To understand how our website is used and to improve our programs and services
• To comply with legal obligations and protect the rights and safety of MSF, our members, and the public
We will not use your personal information for any purpose that is materially different from the purposes described in this policy without first obtaining your consent.
3. Who We Share Your Information With
This is an important section. Please read it carefully.
MSF does not sell your personal information to anyone. MSF does not routinely share your personal information with commercial partners, advertisers, or marketers. We treat your information as something you entrusted to us for a specific purpose, and we act accordingly.
We share your personal information only in the following limited circumstances:
Service providers who help us operate MSF
We share limited personal information with third-party service providers who help us deliver our programs and communications. These service providers are contractually required to use your information only to provide services to MSF and to protect it with appropriate security measures. Our current service providers include:
• MotorsportReg.com (PMH MSR LLC) — our course registration platform
• Constant Contact — used to deliver newsletters and communications to subscribers
• Google (Google Analytics) — for website analytics as described above
• Google Sites — the platform hosting motorsport-safety.org
Opt-in partner programs
From time to time, MSF may identify partner programs, products, or services we believe would benefit our members and the HPDE community — for example, specialized insurance programs, educational resources, or industry partnerships. When MSF wishes to share your information with a partner for these purposes, we will contact you first and ask for your explicit consent before sharing anything.
In practice, this means we will send you an email describing the partner program and asking if you would like to opt in. We will only share your information with that partner if you affirmatively respond yes. If you do not respond, or if you respond no, we will not share your information. Your decision about one partner program will not affect any other aspect of your relationship with MSF.
You may withdraw your consent to partner sharing at any time by contacting us at contact@motorsport-safety.org, and we will instruct the partner to delete any information MSF previously shared, subject to any legal retention obligations the partner may have.
Legal and safety disclosures
We may disclose your personal information if we are required to do so by law, if we receive a valid legal request such as a subpoena or court order, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of MSF, our members, or the public. We will make reasonable efforts to notify you if we are legally compelled to disclose your information, unless we are legally prohibited from doing so.
Business transfers
If MSF is ever involved in a merger, acquisition, reorganization, or transfer of substantially all of its assets, your personal information may be transferred as part of that transaction. In any such transfer, we will ensure that your information continues to be protected under this Privacy Policy or a successor policy that provides equivalent protection.
4. How We Protect Your Information
We use reasonable administrative, technical, and physical safeguards to protect your personal information from unauthorized access, disclosure, alteration, and destruction. These safeguards include:
• Limiting access to personal information to MSF personnel and service providers who need it to perform their duties
• Using industry-standard encryption for data transmitted between your browser and our website
• Relying on reputable service providers with established security practices
• Reviewing our data handling practices periodically to identify and address potential risks
However, no method of transmission over the internet or electronic storage is completely secure. While we strive to protect your personal information, we cannot guarantee absolute security. In the event of a data breach that affects your personal information, we will notify you and applicable regulators as required by law.
5. How Long We Keep Your Information
We retain your personal information only as long as necessary to fulfill the purposes described in this policy, unless a longer retention period is required or permitted by law. In general:
• Course registration information is retained for as long as you remain a participant in MSF programs, plus seven years for financial and legal recordkeeping purposes
• Newsletter and communications subscriptions are retained until you unsubscribe, after which we retain minimal records of your unsubscribe request to honor your preference
• Website analytics information is retained according to Google Analytics default settings, which is currently 14 months
• Correspondence and inquiries are retained for up to three years after the last contact, unless a longer retention is required
When we no longer need your personal information, we will securely delete or anonymize it.
6. Your Rights and Choices
You have several rights regarding your personal information held by MSF:
Access and correction
You may request a copy of the personal information MSF holds about you, and you may request that we correct any information that is inaccurate or incomplete. To make such a request, contact us at contact@motorsport-safety.org.
Deletion
You may request that MSF delete your personal information. We will honor such requests subject to any legal or legitimate business reasons for retaining certain information (for example, financial records required by law).
Unsubscribing from communications
You may unsubscribe from MSF newsletters and promotional communications at any time by clicking the unsubscribe link in any of our emails or by contacting us directly. Even if you unsubscribe from newsletters, we may still send you transactional messages related to courses you have registered for.
Withdrawing partner-sharing consent
If you previously opted in to share your information with an MSF partner, you may withdraw that consent at any time by contacting us at contact@motorsport-safety.org.
California residents — additional rights under the CCPA
If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA). These rights include:
• The right to know what personal information MSF collects, uses, and shares about you
• The right to request deletion of your personal information, subject to legal exceptions
• The right to correct inaccurate personal information
• The right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising purposes
• The right to limit the use of sensitive personal information
• The right to non-discrimination for exercising your privacy rights
MSF does not sell your personal information and does not share it for cross-context behavioral advertising. To exercise any of your CCPA rights, contact us at contact@motorsport-safety.org. We will respond to verifiable requests within 45 days as required by law.
7. Children's Privacy
MSF's website and programs are intended for adults age 18 and older, as well as minors participating in MSF educational programs with parental consent. We do not knowingly collect personal information from children under 13 without verified parental consent as required by the Children's Online Privacy Protection Act (COPPA). If you believe we have collected information from a child under 13 without proper consent, please contact us immediately at contact@motorsport-safety.org and we will promptly delete that information.
8. Third-Party Websites
Our website may contain links to third-party websites, including our registration platform MotorsportReg.com, partner organizations, and informational resources. This Privacy Policy does not apply to third-party websites. When you leave motorsport-safety.org and visit a third-party site, your use of that site is governed by that site's privacy policy. We encourage you to review the privacy practices of any third-party sites you visit.
9. Users Outside the United States
MSF is based in the United States and operates primarily in North America. Our website and services are not directed at users outside the United States and Canada. If you access MSF's website or provide information to us from outside the United States, you understand that your information will be transferred to, stored, and processed in the United States, which may have different data protection laws than your country of residence. By providing your information to MSF, you consent to this transfer and processing.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other reasons. When we make material changes, we will update the Effective Date at the top of this policy and post the revised policy on our website. For significant changes, we will provide additional notice by email to subscribers or through a prominent notice on our website.

Welcome to the Motorsport Safety Foundation website. These Terms of Use ("Terms") are a binding agreement between you and the Motorsport Safety Foundation ("MSF," "we," "us," or "our"), a California nonprofit corporation. These Terms govern your access to and use of the website located at motorsport-safety.org and any content, resources, or materials made available through the website (collectively, the "Site").
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, do not access or use the Site.
We may update these Terms from time to time. When we do, we will post the revised Terms on the Site and update the Effective Date above. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
1. About MSF
The Motorsport Safety Foundation is a 501(c)(3) nonprofit organization dedicated to improving safety in non-competitive motorsports. We provide educational resources, training standards, and community initiatives focused on high-performance driver education and track safety. The Site exists to share information, publish safety resources, and support the HPDE community.
MSF is not affiliated with, endorsed by, or sponsored by any racing sanctioning body, track operator, insurance provider, or manufacturer except where such relationships are expressly disclosed on the Site.
2. Eligibility
The Site is intended for use by adults age 18 and older. By using the Site, you represent and warrant that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
We do not knowingly collect personal information from children under 13 through the Site. Please see our Privacy Policy for more information about how we handle information from minors.
3. License to Use the Site
Subject to your compliance with these Terms, MSF grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. This license does not include any right to:
• Resell or make commercial use of the Site or any content obtained from the Site
• Collect and use any product listings, descriptions, or other Site content for the benefit of any other organization or commercial venture
• Use any data mining, robots, scrapers, or similar data gathering and extraction tools to access Site content
• Download or copy any portion of the Site for any commercial purpose without express written permission from MSF
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site except as explicitly permitted by these Terms
4. Downloadable Resources
MSF makes certain safety guides, educational documents, and reference materials available for download through the Site (collectively, "Resources"). These Resources are provided free of charge as a service to the motorsport community.
You may download, print, and share these Resources for personal, educational, and non-commercial use, including sharing them within your motorsport organization, club, or instructor corps for the purpose of improving safety. You may not:
• Sell, license, or charge others for access to the Resources
• Modify the Resources or create derivative works without MSF's prior written permission
• Remove or alter any MSF logos, attribution, copyright notices, or trademark markings on the Resources
• Claim the Resources as your own work or represent them as content developed by anyone other than MSF
• Use the Resources in any manner that implies MSF's endorsement of your organization, products, or services without MSF's express written consent
The Resources are provided for informational and educational purposes only. They represent baseline recommendations and do not constitute professional advice, official safety standards required by law, or a guarantee of safety at any particular event. The application of any recommendations contained in the Resources is the sole responsibility of the organization or individual implementing them. MSF makes no representation that following the Resources will prevent any particular incident, injury, or loss.
5. Intellectual Property
All content on the Site — including text, graphics, logos, images, documents, guides, software, and the selection and arrangement of all of the above — is the property of MSF or its content providers and is protected by United States and international copyright, trademark, and other intellectual property laws.
"Motorsport Safety Foundation," "MSF," the MSF shield logo, and related names and logos are trademarks of MSF. You may not use MSF's trademarks without our prior written permission, except as expressly permitted by these Terms or by MSF's published brand usage guidelines.
If you wish to use MSF content or trademarks in a manner not expressly permitted by these Terms, please contact us at contact@motorsport-safety.org to request permission.
6. Acceptable Use
You agree to use the Site only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:
• Use the Site in any way that violates any applicable federal, state, local, or international law or regulation
• Use the Site to transmit or distribute any material that is defamatory, obscene, harassing, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site
• Interfere with or disrupt the Site or servers or networks connected to the Site
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity
• Use any automated means to access the Site or collect any information from the Site, including scrapers, bots, or data mining tools
• Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material to the Site

MSF reserves the right to investigate and take appropriate action against anyone who violates these Terms, including removing offending content, suspending or terminating access to the Site, and reporting violations to law enforcement authorities.

The Site may contain links to third-party websites, including but not limited to our registration platform MotorsportReg.com, partner organizations, safety equipment providers, insurance partners, track operators, and informational resources. These links are provided for your convenience only.
MSF does not control these third-party websites and is not responsible for their content, privacy practices, or terms of use. Your use of any third-party website is governed by that website's own terms and policies, not by these Terms. MSF's inclusion of a link to a third-party website does not constitute an endorsement of that website or its content.
When you leave the Site to visit a third-party website, we encourage you to review that site's terms of use and privacy policy before providing any information or engaging in any transactions.
8. Disclaimers
The Site and all content, resources, and materials provided through the Site are offered on an "as is" and "as available" basis, without warranties of any kind, either express or implied. To the maximum extent permitted by applicable law, MSF disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, and availability.
MSF does not warrant that:
• The Site will be uninterrupted, secure, or error-free
• Defects in the Site will be corrected
• The Site or the servers that make it available are free of viruses or other harmful components
• The Site or any content on it will meet your requirements or expectations
• Any information, recommendations, or guidance obtained from the Site will be accurate or reliable for your specific circumstances
Important safety note: MSF provides educational resources and baseline safety recommendations. High-performance driving and motorsport activities are inherently dangerous and can result in serious injury, death, and property damage. No safety practice, guide, or recommendation can eliminate the risks associated with motorsport. Any decision to participate in, organize, or conduct motorsport activities is made at your own risk and must be based on your own judgment, training, and assessment of the circumstances. MSF's Resources are not a substitute for professional training, experienced instruction, proper safety equipment, medical care, or common sense.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall MSF, its directors, officers, employees, volunteers, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use the Site or any content, resources, or materials obtained through the Site.
In no event shall MSF's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Site exceed one hundred US dollars ($100.00) or the amount you paid to MSF (if any) in the twelve months preceding the claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, MSF's liability will be limited to the greatest extent permitted by applicable law.
You acknowledge and agree that the disclaimers and limitations of liability set forth in these Terms are fundamental elements of the basis of the bargain between you and MSF, and that MSF would not be able to provide the Site on an economic basis without such limitations.
10. Indemnification
You agree to defend, indemnify, and hold harmless MSF and its directors, officers, employees, volunteers, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
• Your use of or access to the Site
• Your violation of these Terms
• Your violation of any third-party right, including any intellectual property right, privacy right, or publicity right
• Any claim that your use of the Site caused damage to a third party
MSF reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, in which case you agree to cooperate with MSF's defense of such claim.
11. Governing Law
These Terms and any dispute arising out of or relating to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.
12. Informal Dispute Resolution
Before filing any legal action, you agree to first attempt to resolve any dispute with MSF informally by contacting us at contact@motorsport-safety.org and allowing MSF thirty (30) days to respond and work in good faith to resolve the matter. Many disputes can be resolved through direct communication without the need for formal legal proceedings.
13. Termination
MSF reserves the right to suspend or terminate your access to the Site at any time, with or without notice, for any reason, including but not limited to your violation of these Terms. Upon termination, your right to access and use the Site will cease immediately.
The provisions of these Terms that by their nature should survive termination — including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and this Termination section — shall survive any termination of your access to the Site.
14. Changes to the Site
MSF reserves the right, in its sole discretion, to modify, suspend, or discontinue any aspect of the Site at any time, including the availability of any content, resources, or features, without notice or liability to you.
15. Miscellaneous
Entire agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and MSF regarding your use of the Site and supersede any prior agreements or understandings between you and MSF on this subject.
Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
No waiver
MSF's failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. No waiver of any term of these Terms will be deemed a further or continuing waiver of that term or any other term.
Assignment
You may not assign or transfer these Terms or your rights under these Terms without MSF's prior written consent. MSF may freely assign or transfer these Terms and its rights and obligations under these Terms without your consent.
No agency
Nothing in these Terms creates any agency, partnership, employment, or joint venture relationship between you and MSF.
Force majeure
MSF will not be liable for any failure or delay in performing its obligations under these Terms when such failure or delay results from causes beyond MSF's reasonable control, including but not limited to natural disasters, acts of war, government actions, labor disputes, or internet service interruptions.
